... revisions to the draft Wireless Communications Facilities regulations ...

Chapter 813 - Conditional Uses

Criteria pertaining to conditional use approval for a Temporary WCF. Note that the conditional use provisions apply only to Temporary WCF; the previous draft of Chapter 834 (Wireless Communications Facilities chapter) required conditional use approval for all WCF not within a permitted use district (an Overlay area).

Chapter 834 - Wireless Communications Facilities

834-1

The purpose statement was revised as recommended. The draft now assumes a stronger regulatory tone (i.e. the reference to "adequate" wireless communications services, rather than "necessary and desirable") and includes specific mention of public & semi-public properties. It also alludes to the interests of citizens & property owners, as well as the Plan Commission & County Commissioners.

m o d e l s: Urbana, Bloomington MN.

834-2

(A) This section has been revised to eliminate the conditional use provisions. In essence, new WCF or Support Structures not within an existing WCF Overlay District would require rezone approval. (i.e. a rezone from Estate Residential to Estate Residential with the WCF Overlay).

(B) A sixth condition of approval has been added to address compatibility concerns.

m o d e l s: Napa County, Bloomington MN., Murraysville.

834-3

(A) Two requirements have been added - numbers 5 and 8; these address visual impact and bond requirements.

m o d e l s: Napa County, Bloomington IN.

834-4

- no changes -

834-5

Two additional standards have been added: (D) and (F); signage and noise. In addition, the lighting standards in (B) have been revised to prohibit strobe lighting at night & require motion detection equipment for security lighting. Also: Setback requirements in Table 34-1 have been altered.

m o d e l s: Napa County, Urbana, Bloomington MN.

834-6

Provisions for Temporary WCF have been tightened - now a maximum of 7 days (reduced from 60), subject to an additional 7-day extension.
